The following conditions constitute the contracting conditions and expressly regulate the commercial relations that may be established between interested clients, visitors or guests (hereinafter, “User/s”) and C&O Beach, through the use of this virtual store “www. cobeach.net" (hereinafter, the "Portal") in which the contract can be formalised for the purchase of products offered on the Portal during its period of availability.
These contracting conditions will be in force during the time that the products are accessible through the Portal and Users will be subject to them at the time of placing their order. We recommend Users to consult them periodically as they may be modified. Likewise, we reserve the right to replace both the General Conditions and the Particular Conditions at any time with updated conditions that will apply from the moment they are available to Users on the Portal.
Users must accept these Terms and Conditions that may be applicable. If, on the contrary, they decide not to accept them, they should refrain from accessing and using this Portal.
In the event of a contradiction between the Terms and Conditions stated in these General Conditions and the Particular Conditions, the conditions agreed upon in the latter will always prevail over the former, when they are incompatible, and only with respect to the products subject to specific conditions set.
Any query, suggestion or claim related to the online sale of products on the Portal will be managed contacting our Customer Service by sending an email to "info@cobeach.net".
Access and Use of the Portal
To purchase products on the Portal, the User will be required to register by creating a customer account, generate a password and complete a form that is displayed following the instructions indicated therein. On the other hand, the User may choose to purchase as a guest (without the obligation to create an account). Throughout this registration process, the data provided must be accurate, truthful and up-to-date.
The User's email account and password are necessary to register on the website at any other time after the purchase and to make future purchases under the User’s account, which are confidential, personal and non-transferable. The User will not be able to modify the email account, the user will only be able to modify his/her password and will be responsible for the adequate custody and confidentiality of them, not being able to assign their use to any third party. In addition, the user commits to notify immediately C&O Beach of access to the Portal by any third party who may have used the User’s email account and password, if known.
Any purchase of products through the Portal will be considered validly made by the User and will be binding. The User will be exclusively responsible for any purchase of products through the Portal by a third party that makes use of their customer account. If the purchases were made by a minor who falsified the registration information, they will be understood as made under the supervision and authorisation of their parents, guardians or legal representatives.
Information and availability of Products
The products offered on the Portal, together with their essential characteristics and price, will appear on the screen. Before confirming the order, the total shipping costs to the User's address will also appear, if any. Possible Discounts or Offers will be duly indicated on the screen.
C&O Beach reserves the right to decide at any time the products that are offered to the User through the Portal. In this way, new products may be added to those included, understanding, unless otherwise provided, that such new products will be governed by the provisions of the Terms and Conditions in force at that time. Likewise, C&O Beach reserves the right to withdraw without prior notice and at any time the products it deems appropriate.
Any order placed through the Portal will be subject to the effective availability of stock of the products that it includes at the moment in which is prepared for shipment.
In the event that any of the products in the order are not available for shipment, the Customer Service Department will contact the User to inform, and the User can choose between receiving the order with the available products or cancelling the entire order. In the latter case, we will proceed to cancel the order and refund the amount paid immediately.
Prices, Taxes and Shipping Costs
Prices of the products are always shown in Euros and including VAT (if applicable) and any other applicable tax in force. If C&O Beach identifies an error in the price of products, it will inform the User who will have to reconfirm their order at the correct price or cancel it.
Price of products includes shipping costs only for deliveries to mainland Spain and the Balearic Islands. Otherwise, the shipping costs are borne by the User and will be added to the total amount of the selected products. Users will be informed of shipping costs, which will be duly broken down prior to making the payment before confirming the order and finalising the purchasing process. The Portal expressly reserves the right to modify prices at any time without prior notice. In any case, the rates in force indicated at the time of placing the corresponding order will always be applied to the invoice.
Purchasing Process
To place an order on the Portal, the User must:
- Select products and add them to the "Cart"
- Pay attention to availability and delivery times
- Register as a Client or buy as a guest, filling in the information requested in the form
- Include the billing address and the shipping address if they are different
- Check the veracity and accuracy of all data
- Select the Payment Method, and make the payment
- Finally click on the "Place the Order" button

Once the order has been received on our Portal, we will immediately send a Confirmation of Reception of the Order via email to the email address that the User has indicated in the order, which will include the printed order with the data provided. From that moment on, your order will be considered a Purchase Offer that the User makes to us for the products selected on the Portal, in accordance with the contracting conditions shown in this document. This purchasing offer will be processed and we will determine if it can accepted or rejected in the event of any incident. In addition, there will be a verification of the reception of the order’s amount.
If there is no incident that prevents placing the order, we will accept it and send it, generating a shipping confirmation via email to the email address the User provided.
In the event of such incidents that, despite our efforts to supply the products requested by the User, prevent us from carrying out the complete supply of all the products in the order within the set time, either because some product is not available, it is not manufactured or there is some difficulty to send it, we will contact the User by telephone or through the email provided and will offer you the possibility of supplying alternative products or a new delivery time will be established.
If the User does not agree, the order will be cancelled and any amount paid for the order will be immediately refunded. The refund of this amount will be the limit of our responsibility towards the User due to our impossibility of supplying the requested products.
Payment of the Order
The User may pay for the products included in their Order using the means of payment that appear in the payment methods section of the Portal in the currency specified in the order.
The dispatch of the order to the User will not begin until the receipt of payment has been verified. The User must take into account that this circumstance could delay the delivery time of the order. If the full amount of the order is not received within a period of 15 days from the date of its creation, it will be cancelled.
Delivery times
C&O Beach manages orders on a daily basis and delivery times depend on the availability of each product included in the order.
The delivery times of each product vary in relation to different parameters such as the level of stocks, the preparation time of the order, the means of transport used for delivery, among others. Taking into account all those parameters that determine the delivery time from when the order is complete until the items can be delivered to the shipping address indicated by the User, we estimate the approximate delivery date of the product.

All delivery times are considered in business days from Monday to Friday, excluding bank holiday. The published delivery times are estimates of the usual delivery time of the products.
Forms of Shipping, Freight and Expedition of the Order
After sending the order confirmation via email, the products and their packaging will be prepared and the corresponding invoice will be generated, which will include the list of products purchased, quantities, prices, taxes included and all additional expenses (if applicable) as stated in the order. This invoice will also be attached to the mentioned email. Shipping costs are shown to the User when setting the delivery addres to their order and are included with the total amount of the order.
When several products with different delivery times are included in an order, a single delivery will be made when all the products in the order are available, therefore the delivery time of the global order is conditioned to the products with the longest term of delivery. However, the User can decide if he is interested in us immediately supplying the available products in a shorter period of time and wait for a second shipment for the rest of the order. These partial supplies of the order will be treated as two orders for the purposes of shipping costs, and free shipping offers may be invalidated in some cases.
The order will be sent through a shipping company to the indicated delivery address. The ownership of the products delivered will be transferred to the User when they are delivered by the carrier after the User signs the delivery note or receives the package, once the delivered items have been reviewed.
If upon delivery of the order, the User is not at the set delivery address, the carrier will leave a notice for them to contact the delivery company. In this case, the additional costs are borne by the User.
In the event of finding any anomaly in the products delivered due to errors in the products received with respect to the products ordered, defects or other causes of disagreement, you should contact the Customer Service within 24 hours of reception of the items through the email "info@cobeach.net" and specify what happened. If the defect was visible at the moment of delivery of the product/s, the incident must be detailed upon delivery of the product by the carrier on the delivery note. In this regard, we recommend that you consult the following section "Incidents and Returns".
Incident and Return Policy
Right of Withdrawal - Pursuant to the provisions of the Retail Trade Regulation Law, the User has the right to cancel the purchase made through the Portal, and therefore, if it is not satisfied, and provided that the very nature of the property acquired allows it, it can return the product within a maximum period of fourteen (14) calendar days from the date of delivery of the order at the indicated address. Once the interest in cancelling the purchase has been expressed, there is a maximum period of fourteen (14) calendar days to return the items purchased.
In any case, the return of any product requires the agreement between C&O Beach and the User. For the purposes of making use of the right of withdrawal, it is essential that the products are in perfect condition, have not been used, remain with their original labelling and are returned folded in their original packaging as they were delivered, also in perfect condition. Under no circumstances, the return of products will be accepted if the outer label of the products is removed. The refund of the purchase amount, when applicable, will be made in the same means of payment with which the product was purchased. The shipping costs of returning the products will be paid by the User, who assumes all the risks derived from the shipping of the returned products. It is recommended to insure the merchandise returned.
The return of products can be made by sending an email to the Customer Service through the email "info@cobeach.net", where the steps to follow will be indicated. Before returning products, the User must ensure that the parcel is duly protected and sealed so that it does not suffer any damage during transport.
Excluded from the right of withdrawal are those cases in which, due to the very nature of the goods being acquired, it is impossible to carry them out, without prejudice to the corresponding claim for damages suffered, including, specifically: those products made according to the User's specifications or clearly personalised.
Incidents in the delivery - In the event that the User, upon receiving the delivery, detects some type of incident, finds packages in poor condition or the lack of any package, the User must indicate it at the time of reception in writing on the delivery note of the carrier. In addition, the User must communicate the incident within a period of less than 24 hours through the email "info@cobeach.net".
Defective Products - If the User receives a defective product, C&O Beach will take care, when possible, of replacing the product, without any additional cost. In the event that replacement of products is not possible due to unavailability, the full refund of the purchase will be made.
Cancellation of Orders - The User may cancel its order as long as it has not been issued. Order cancellations must be made through the email "info@cobeach.net". Within 24/48 hours, C&O Beach will contact the User and proceed to refund the amount paid using the payment method agreed between the parties.
Guarantee
The general warranty conditions for each product are determined by the manufacturer that grants the warranty. The manufacturer is the one that appears on the product labelling. When the Product purchased presents a lack of conformity because it does not correspond to the characteristics offered, or some defect that prevents its normal use according to its nature, or does not offer the benefits described, the User will have the right to return the good purchased under the conditions and with the means of proof regulated in the Consolidated Text of the General Law for the Defense of Consumers and Users, without prejudice to verifying the veracity of the defects, their origin and the moment of their appearance.
The images used on the website are informative and not contractual. They try to reflect as faithfully as possible the colours and details of the products shown, but there may be variations between the image and the actual product, due to both technical factors in the manufacture of the products and the technology used to display the images.
In any case, the regulation on the guarantee of sale of consumer goods established by the applicable legislation will be applied.
